Construction Seminar: Legal and practical issues arising from complex disputes

We are delighted to invite you to a panel discussion on the legal
and practical issues arising from complex disputes.

Construction disputes often involve multiple processes. For example, serial adjudications, escalation from a DAB to arbitration, parallel disputes across a portfolio of projects, or concurrent upstream and downstream disputes. Managing this thicket of disputes presents a range of challenges but also
opportunities.

The discussion will consider these kinds of issues including:

• Drafting dispute escalation provisions
• Escalation clauses: enforceability of obligations, time bars, framing the arguments
• Managing parallel upstream and downstream disputes on overlapping issues
• Serial disputes: sub-dividing the case
• Concurrent dispute processes: serial defects across different projects
